Can Foreigners Buy Property in Aruba? What the Rules Actually Say

It's the first question almost every US or Canadian buyer asks, usually with a little dread attached: am I even allowed to buy here? The short answer is the good news version.

The rule as it stands.

To date there are no specific restrictions on foreign nationals buying property in Aruba. You can acquire freehold property with the same rights as a local buyer. Ownership is recorded centrally at the Kadaster, Aruba's public land registry — which is also why title insurance, standard practice in the US, is generally not needed here.

What buying does not do.

Buying property does not automatically grant you residency. Those are two separate tracks. If living on the island part- or full-time matters to you, residency information starts with DIMAS, and the specific route — retiree, investor, or professional — is a question for a qualified Aruban immigration lawyer.

One point worth clearing up, because it circulates a lot online: the Dutch–American Friendship Treaty (DAFT) is a residence and establishment treaty, not a tax treaty — and whether it applies in Aruba is something to confirm with an immigration lawyer rather than assume.

Where the real friction is.

Not permission — money and paperwork. Non-resident buyers commonly need closer to 50% down, where local buyers often put 20–30%. Banks apply rigorous anti-money-laundering checks, and simply opening an account can take two to four months, sometimes with charges for the compliance review. Start the bank conversation early; leaving financing until after you've committed to a property is one of the most common and most expensive missteps.
